{"id":16472,"date":"2022-05-09T07:32:22","date_gmt":"2022-05-09T11:32:22","guid":{"rendered":"https:\/\/www.edilex.com\/?p=16472"},"modified":"2026-05-08T10:50:35","modified_gmt":"2026-05-08T14:50:35","slug":"budget-federal-2022-nouvelle-regle-sur-les-reventes-precipitees-de-biens-immobiliers-residentiels-flips-immobiliers","status":"publish","type":"post","link":"https:\/\/edilex.com\/fr\/blog\/2022\/05\/09\/budget-federal-2022-nouvelle-regle-sur-les-reventes-precipitees-de-biens-immobiliers-residentiels-flips-immobiliers\/","title":{"rendered":"Budget f\u00e9d\u00e9ral 2022 : Nouvelle r\u00e8gle sur les reventes pr\u00e9cipit\u00e9es de biens immobiliers r\u00e9sidentiels (flips immobiliers)"},"content":{"rendered":"<p>Dans le cadre du budget f\u00e9d\u00e9ral du 7 avril 2022, le gouvernement serre la vis face aux propri\u00e9taires d\u2019immeubles r\u00e9sidentiels qui proc\u00e8dent \u00e0 une op\u00e9ration d\u2019achat-revente rapide, aussi connue sous le nom de <em>flip<\/em> immobilier, pour r\u00e9aliser un profit \u00e0 court terme.<\/p>\n<p>De fa\u00e7on g\u00e9n\u00e9rale, lorsqu\u2019une personne acquiert un immeuble r\u00e9sidentiel avec l\u2019intention de le conserver \u00e0 long terme, dans le but de l\u2019occuper personnellement ou d\u2019en faire un immeuble locatif pour de la location de longue dur\u00e9e, la vente ult\u00e9rieure de cet immeuble g\u00e9n\u00e9rera un gain en capital, dont la moiti\u00e9 constitue un revenu imposable. Dans le cas o\u00f9 la personne occupe l\u2019immeuble \u00e0 titre de r\u00e9sidence principale, le vendeur b\u00e9n\u00e9ficie d\u2019une exemption d\u2019imp\u00f4t sur ce gain en capital, qui est alors r\u00e9alis\u00e9 libre d\u2019imp\u00f4t.<\/p>\n<p>Cependant, lorsqu\u2019une personne acquiert un immeuble r\u00e9sidentiel en vue d\u2019une revente rapide (apr\u00e8s r\u00e9novation ou non) dans le cadre d\u2019un <em>flip <\/em>immobilier, ou avec l\u2019intention d\u2019en faire un bien locatif pour de la location de courte dur\u00e9e (de type <em>Airbnb<\/em>), la vente ult\u00e9rieure de cet immeuble sera consid\u00e9r\u00e9e comme un \u00ab\u00a0projet comportant un risque ou une affaire de nature commerciale\u00a0\u00bb. Le produit de la vente constitue alors un revenu d\u2019entreprise, qui lui, est imposable en totalit\u00e9. De plus, aucune exemption n\u2019est possible pour le vendeur de l\u2019immeuble, m\u00eame s\u2019il l\u2019a occup\u00e9 \u00e0 titre de r\u00e9sidence principale.<\/p>\n<p>Par cons\u00e9quent, pour d\u00e9terminer le traitement applicable au produit de la vente d\u2019un immeuble, il est n\u00e9cessaire d\u2019analyser l\u2019intention de la personne au moment de l\u2019achat de l\u2019immeuble, mais \u00e9galement plusieurs autres crit\u00e8res identifi\u00e9s par les tribunaux pour une analyse au cas par cas (emplacement de l\u2019immeuble, zonage, expertise du vendeur en immobilier, dur\u00e9e de d\u00e9tention, raison de la vente, etc.). Jusqu\u2019\u00e0 pr\u00e9sent, la loi ne pr\u00e9voyait pas de dur\u00e9e minimale de d\u00e9tention pour consid\u00e9rer le produit de la vente d\u2019un immeuble comme un gain en capital, plut\u00f4t que comme un revenu d\u2019entreprise.<\/p>\n<p>\u00c0 compter du 1<sup>er<\/sup> janvier 2023, les profits d\u00e9coulant de la vente d\u2019un immeuble r\u00e9sidentiel seront r\u00e9put\u00e9s constituer un revenu d\u2019entreprise d\u00e8s lors que le contribuable a d\u00e9tenu l\u2019immeuble pour une p\u00e9riode de moins de 12 mois. L\u2019introduction de cette pr\u00e9somption de revenu d\u2019entreprise signifie \u00e9galement que le vendeur ne peut plus se pr\u00e9valoir de l\u2019exemption pour r\u00e9sidence principale pour toute revente survenue moins de 12 mois apr\u00e8s l\u2019achat.<\/p>\n<p>Des exceptions sont pr\u00e9vues pour tenir compte de certaines circonstances personnelles qui justifient la revente rapide\u00a0:<\/p>\n<ul>\n<li>D\u00e9c\u00e8s du vendeur ou d\u2019une personne li\u00e9e \u00e0 celui-ci<\/li>\n<li>Ajout au m\u00e9nage (naissance d\u2019un enfant, adoption, soins d\u2019un parent \u00e2g\u00e9)<\/li>\n<li>S\u00e9paration<\/li>\n<li>S\u00e9curit\u00e9 personnelle (menace, violence familiale)<\/li>\n<li>Incapacit\u00e9 ou maladie grave<\/li>\n<li>Changement d\u2019emploi (si \u00e0 plus de 40 km) ou cessation d\u2019emploi involontaire<\/li>\n<li>Insolvabilit\u00e9 (ou pour \u00e9viter l\u2019insolvabilit\u00e9)<\/li>\n<li>Disposition involontaire (expropriation, destruction ou condamnation de l\u2019immeuble)<\/li>\n<\/ul>\n<p>Cette nouvelle mesure bas\u00e9e sur la dur\u00e9e de d\u00e9tention s\u2019apparente \u00e0 un traitement qui existe d\u00e9j\u00e0 depuis plusieurs ann\u00e9es aux \u00c9tats-Unis, o\u00f9 le gain r\u00e9alis\u00e9 lors de la vente de tout bien d\u00e9tenu pour une p\u00e9riode de moins d\u2019un an est consid\u00e9r\u00e9 comme un revenu ordinaire, et non comme un gain en capital.<\/p>\n<p>Par ailleurs, cette nouvelle mesure ne change pas les r\u00e8gles actuelles concernant les personnes qui r\u00e9alisent eux-m\u00eames des r\u00e9novations d\u2019immeubles r\u00e9sidentiels qu\u2019ils n\u2019habitent pas, en vue de faire des <em>flips<\/em> immobiliers. Dans ce cas, la licence d\u2019entrepreneur de la R\u00e9gie du B\u00e2timent du Qu\u00e9bec est requise pour pouvoir proc\u00e9der aux travaux, et le revenu g\u00e9n\u00e9r\u00e9 lors de la vente est
