{"id":17527,"date":"2022-07-06T10:10:22","date_gmt":"2022-07-06T14:10:22","guid":{"rendered":"https:\/\/www.edilex.com\/?p=17527"},"modified":"2026-04-16T09:38:01","modified_gmt":"2026-04-16T13:38:01","slug":"de-nouvelles-exigences-pour-les-courtiers-immobiliers","status":"publish","type":"post","link":"https:\/\/edilex.com\/fr\/blog\/2022\/07\/06\/de-nouvelles-exigences-pour-les-courtiers-immobiliers\/","title":{"rendered":"De nouvelles exigences pour les courtiers immobiliers"},"content":{"rendered":"<p>Dans la foul\u00e9e de la surchauffe immobili\u00e8re, le l\u00e9gislateur a en d\u00e9cembre 2021 adopt\u00e9 un projet de loi<a href=\"#_ftn1\" name=\"_ftnref1\"><em><strong>[1]<\/strong><\/em><\/a> visant \u00e0 modifier la <em>Loi sur le courtage immobilier<a href=\"#_ftn2\" name=\"_ftnref2\"><strong>[2]<\/strong><\/a><\/em> afin de mieux prot\u00e9ger les acheteurs d\u2019une propri\u00e9t\u00e9 immobili\u00e8re. Ces modifications sont entr\u00e9es en vigueur le 10 juin dernier et auront pour effet\u00a0:<\/p>\n<ul>\n<li>d&rsquo;interdire aux titulaires de permis de l\u2019Organisme d&rsquo;autor\u00e9glementation du courtage immobilier du Qu\u00e9bec (OACIQ) d&rsquo;agir \u00e0 la fois pour l&rsquo;acheteur et le vendeur lors d&rsquo;une transaction, sauf dans les cas o\u00f9 :\n<ul>\n<li>aucun autre courtier n&rsquo;a son \u00e9tablissement dans un rayon de 50 kilom\u00e8tres de l&rsquo;immeuble en jeu,<\/li>\n<li>l&rsquo;acheteur et le vendeur sont li\u00e9s au m\u00eame titulaire de permis, car ils ont conclu des contrats les liant \u00e0 la m\u00eame agence, mais sont dans les faits servis par des courtiers diff\u00e9rents, tous deux li\u00e9s \u00e0 cette agence;<\/li>\n<\/ul>\n<\/li>\n<li>de renforcer l&rsquo;exigence, pour les courtiers souhaitant repr\u00e9senter des acheteurs, de conclure avec eux un contrat de courtage achat \u00e0 l&rsquo;aide du formulaire obligatoire pr\u00e9vu \u00e0 cet effet et en rendant nulles les ententes verbales.<\/li>\n<\/ul>\n<p>Ces modifications auront pour effet de clarifier et d&rsquo;encadrer, dans l&rsquo;int\u00e9r\u00eat des acheteurs, le r\u00f4le des courtiers qui peuvent interagir avec ces derniers.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"font-size: 20px;\"><strong>Le devoir des courtiers<\/strong><\/h2>\n<p>Le minist\u00e8re des Finances (MFQ) et l&rsquo;OACIQ rappellent que les courtiers ont toujours le devoir de fournir un traitement \u00e9quitable aux consommateurs avec qui ils interagissent, c&rsquo;est-\u00e0-dire de donner de mani\u00e8re objective l&rsquo;information pertinente, notamment \u00e0 l&rsquo;\u00e9gard des droits et obligations de toutes les parties. De plus, ils ont l&rsquo;obligation de prot\u00e9ger et de promouvoir les int\u00e9r\u00eats d&rsquo;un acheteur dans le cas o\u00f9 ils ont conclu un contrat \u00e9crit avec lui. Par cons\u00e9quent, en l&rsquo;absence d&rsquo;un contrat de courtage achat, les courtiers agissent pour le vendeur ou pour le courtier du vendeur.<\/p>\n<p>Le MFQ et l&rsquo;OACIQ souhaitent \u00e9galement aviser les acheteurs faisant affaire avec un courtier li\u00e9 \u00e0 la fois par un contrat de courtage avec l&rsquo;acheteur et avec le vendeur que le courtier a d\u00e9sormais l&rsquo;obligation de r\u00e9silier le contrat de courtage achat afin d&rsquo;\u00e9viter de se retrouver en situation de double repr\u00e9sentation. Suivant cette r\u00e9siliation, le courtier aura l&rsquo;obligation de prot\u00e9ger et promouvoir uniquement les int\u00e9r\u00eats du vendeur de la propri\u00e9t\u00e9.
