Pouvez-vous encore \u00eatre redevable de la commission de votre courtier immobilier\u2009? Eh bien, il s\u2019av\u00e8re que oui. Comme le d\u00e9montre la jurisprudence, les parties \u00e0 une transaction doivent porter une attention tr\u00e8s particuli\u00e8re aux termes et au libell\u00e9 de la convention d\u2019achat et de vente et dans une r\u00e9cente <a href=\"https:\/\/www.bccourts.ca\/jdb-txt\/sc\/22\/06\/2022BCSC0646.htm\">d\u00e9cision de la Cour supr\u00eame<\/a> de la Colombie-Britannique, le juge a fait exactement cela.<\/p>\n<p>Dans cette affaire r\u00e9cente, les vendeurs et l\u2019acheteur ont proc\u00e9d\u00e9 \u00e0 la signature d\u2019un contrat de vente pour l\u2019achat de deux chalets situ\u00e9s pr\u00e8s de la ville de Mission en Colombie-Britannique, apr\u00e8s quoi l\u2019acheteur a avanc\u00e9 un d\u00e9p\u00f4t non remboursable de 60\u2009000\u00a0$ aux vendeurs. L\u2019acheteur a ensuite demand\u00e9 un report de la date de cl\u00f4ture, mais cette date est pass\u00e9e sans que la cl\u00f4ture ait lieu et l\u2019acheteur \u00e9tait introuvable.<\/p>\n<p>Le d\u00e9faut de proc\u00e9der \u00e0 la cl\u00f4ture de la transaction signifiait que l\u2019acheteur perdait son d\u00e9p\u00f4t de 60\u2009000\u00a0$ et les vendeurs consid\u00e9raient que l\u2019accord n\u2019\u00e9tait donc plus ex\u00e9cutoire. Au lieu de cela, et \u00e0 leur grande surprise, les vendeurs ont re\u00e7u une action en justice exigeant une commission du prix d\u2019achat total plus les int\u00e9r\u00eats pour la vente avort\u00e9e.<\/p>\n<p>Apr\u00e8s avoir examin\u00e9 de pr\u00e8s la convention d\u2019achat et de vente sign\u00e9e, les vendeurs ont d\u00e9couvert que l\u2019agent immobilier n\u2019avait besoin que d\u2019un contrat de vente l\u00e9galement ex\u00e9cutoire pour percevoir sa commission et, dans le cas pr\u00e9sent, la clause de commission ne faisait pas r\u00e9f\u00e9rence \u00e0 une cl\u00f4ture ou \u00e0 un ach\u00e8vement et, lue seule, elle \u00e9tait simplement li\u00e9e \u00e0 l\u2019existence d\u2019un contrat ex\u00e9cutoire. Par cons\u00e9quent, la Cour supr\u00eame a jug\u00e9 que la demande de commission \u00e9tait fond\u00e9e sur l\u2019affirmation que la clause de commission \u00e9tait d\u00e9clench\u00e9e par l\u2019existence d\u2019un contrat de vente ex\u00e9cutoire et qu\u2019il n\u2019\u00e9tait pas n\u00e9cessaire que la transaction soit achev\u00e9e.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Prot\u00e9ger vos int\u00e9r\u00eats<\/strong><\/p>\n<p>Pour prot\u00e9ger vos int\u00e9r\u00eats, il est essentiel d\u2019avoir une convention d\u2019achat et de vente bien r\u00e9dig\u00e9e. Toute d\u00e9claration faite, et \u00e0 laquelle les parties se fient par la suite, peut entra\u00eener des probl\u00e8mes lorsque les parties promettent quelque chose, mais ne tiennent pas leurs promesses \u00e0 la cl\u00f4ture. Les parties \u00e0 une convention d\u2019achat et de vente doivent s\u2019assurer qu\u2019elles comprennent parfaitement leurs obligations et que les conditions sont satisfaisantes pour elles.<\/p>\n<p>Compte tenu du climat immobilier actuel, il est peut-\u00eatre juste de dire que les associations immobili\u00e8res devraient examiner de plus pr\u00e8s leurs accords types et envisager d\u2019y apporter des modifications, \u00e9tant donn\u00e9 le manque de pouvoir de n\u00e9gociation pour y apporter des modifications et le manque d\u2019expertise de la personne moyenne
