Cette grande libert\u00e9 dans la description de ses besoins lui permet, par exemple, de demander un bien d\u2019une marque particuli\u00e8re. Les tribunaux ont cependant fix\u00e9 certaines r\u00e8gles visant \u00e0 encadrer le pouvoir de la municipalit\u00e9 de d\u00e9crire le bien ou le service recherch\u00e9. D\u2019une part, la municipalit\u00e9 doit s\u2019assurer que les exigences qu\u2019elle impose ne r\u00e9duisent pas la concurrence de mani\u00e8re trop significative ou ne l\u2019\u00e9liminent pas compl\u00e8tement, car son appel d\u2019offres pourrait alors \u00eatre qualifi\u00e9 de \u00ab\u00a0dirig\u00e9\u00a0\u00bb. D\u2019autre part, elle doit \u00eatre en mesure de d\u00e9montrer que le respect des exigences impos\u00e9es est n\u00e9cessaire afin de r\u00e9pondre \u00e0 ses besoins. Autrement dit, elle doit pouvoir \u00e9tablir un lien rationnel entre ses exigences et le besoin recherch\u00e9 par son appel d\u2019offres.<\/p>\n<p style=\"text-align: justify;\">L\u2019entr\u00e9e en vigueur, le 19 avril dernier, de la loi 155 a cependant eu pour effet d\u2019ajouter une restriction importante au pouvoir d\u2019une municipalit\u00e9 de fixer les sp\u00e9cifications d\u2019un bien ou d\u2019un service recherch\u00e9. En effet, une nouvelle disposition<a title=\"\" href=\"\/\/53BACC4E-8579-4791-9132-D84A9E41A269#_ftn2\">[2]<\/a>introduite par la loi 155 pr\u00e9voit que, lorsqu\u2019une municipalit\u00e9 impose certaines sp\u00e9cifications techniques concernant un bien ou un service, elle doit les d\u00e9crire \u00ab\u00a0<em>en termes de performance ou d\u2019exigence fonctionnelle plut\u00f4t qu\u2019en termes de caract\u00e9ristiques descriptives<\/em>\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">La loi 155 privil\u00e9gie donc la r\u00e9daction de devis \u00ab\u00a0<em>de performance<\/em>\u00a0\u00bb, qui pr\u00e9cisent uniquement les r\u00e9sultats attendus et laissent aux soumissionnaires le choix des moyens pour les atteindre, par opposition \u00e0 des devis strictement \u00ab\u00a0<em>techniques<\/em>\u00a0\u00bb, qui \u00e9num\u00e8rent dans le d\u00e9tail les diff\u00e9rentes caract\u00e9ristiques descriptives du bien ou du service recherch\u00e9. Alternativement, la municipalit\u00e9 peut d\u00e9crire son besoin en termes \u00ab\u00a0<em>d\u2019exigence fonctionnelle<\/em>\u00a0\u00bb. Cette expression n\u2019est pas d\u00e9finie dans la loi 155, mais semble viser le sc\u00e9nario dans lequel la municipalit\u00e9 ne peut pas, de mani\u00e8re r\u00e9aliste, accepter un bien ou un service autre que celui employ\u00e9 dans le pass\u00e9, en raison de diff\u00e9rentes contraintes. Par exemple, une municipalit\u00e9 qui \u00e9met un appel d\u2019offres visant l\u2019acquisition de v\u00e9hicules pourrait exiger que les v\u00e9hicules soient d\u2019une marque pr\u00e9cise si elle dispose d\u2019un inventaire de pi\u00e8ces compatibles avec des v\u00e9hicules de cette marque seulement et souhaite maintenir la garantie apr\u00e8s-vente en place. Une telle interpr\u00e9tation de l\u2019expression \u00ab\u00a0<em>exigence fonctionnelle<\/em>\u00a0\u00bb permet de maintenir l\u2019approche des tribunaux qu\u00e9b\u00e9cois \u00e0 l\u2019effet qu\u2019une municipalit\u00e9 peut cibler un bien ou un service pr\u00e9cis s\u2019il existe un lien rationnel entre ses exigences et le contexte de son appel d\u2019offres.<\/p>\n<p style=\"text-align: justify;\">Dans l\u2019\u00e9ventualit\u00e9 o\u00f9 une municipalit\u00e9 n\u2019est pas en mesure de d\u00e9finir son besoin en termes de performance ou d\u2019exigence fonctionnelle, elle peut indiquer aux documents d\u2019appel d\u2019offres une liste des caract\u00e9ristiques descriptives du bien ou du service recherch\u00e9, mais est dans l\u2019obligation de consid\u00e9rer conforme une proposition d\u2019un soumissionnaire qui est \u00e9quivalente \u00e0 ces caract\u00e9ristiques.
